The “Right to Disconnect” Is Now The Law
How many businesses are aware of Ontario's new "Working for Workers Act" which was assented to December 2nd, 2021?
This new legislation not only directly addresses one of the major causes of job burnout, but also serves to assist employers with managing staff workload outside of the workplace and/or while "off the clock" by providing new mandates as part of a wholistic strategy for facilitating and maintaining employee work/life balance. With it comes the requirement for most companies with 25 employees or more to draft and distribute a "Disconnecting From Work" policy. Obligated organizations had until July 1st, 2022 to draft the new policy, and March 1st thereafter annually for growing businesses whose staff counts hit 25+ at the start of any year.
Specifically, Part VII.0.1, under "Written policy on disconnecting from work" states in 21.1.2 (1):
"An employer that, on January 1 of any year, employs 25 or more employees shall, before March 1 of that year, ensure it has a written policy in place for all employees with respect to disconnecting from work that includes the date the policy was prepared and the date any changes were made to the policy"
The act defines disconnecting from work as "not engaging in work-related communications, including emails, telephone calls, video calls or the sending or reviewing of other messages, so as to be free from the performance of work". Furthermore, the act outlines the requirement to distribute the finished policy to every employee within 30 days of it having been completed, and to ensure that each newly hired employee thereafter receives a copy within the first 30 days of their employment.
